Job Description:
Our client is a prestigious medium sized corporate law firm based in Sandton, with an outstanding client base and exceptional brand. They are looking for a Business Rescue and Insolvency Senior Associate to join their dynamic team.
Duties & Responsibilities
Insolvency law and insolvency litigation, including advice on business rescue proceedings, debt recovery, sequestrations and liquidations.
Provide legal support to the Business Support and Recoveries departments and working closely with the recovery specialists on various types of accounts.
Avoiding litigation and applying pressure to conclude commercial settlements - successful negation and conclusion
Identifying and alerting client of potential legal risks – resulting in lower instances of litigation for clients; thereby reducing their legal spend accordingly.
Demonstrating speed and accuracy in drafting and launching of urgent applications and ability to work under pressure; resulting in minimal legal costs and maximum recovery for clients.
Independent management of workload and client relationships – experienced in developing and maintaining close working relationships and independently managing client expectations.
Management and mentorship of support staff and junior members of professional staff - resulting in open communication within team structure; good motivation and personal growth within team.
Ability to explain complex legal issues to non-legal individuals – resulting in better engagement with client and understanding of risk versus reward of litigation.
Conducting sale of business for corporate entities and individuals.
Drafting court applications of money judgments, sequestrations, liquidations and other general debt collections.
Drafting and issuing court summons and applications, including liquidation applications, money judgment applications, sequestration applications;
Conducting commissions of inquiry (investigations of monies and debts owed by a debtor of clients and mechanisms of recovering the monies owed to clients)
Conducting Sales in Execution
Drafting Applications for Sale in Execution of immovable and movable property
Drafting general court applications for the recovery of the debts payable to clients
Researching and drafting legal opinions, in the realm of company law
Attending client meetings, creditors meetings for proof of claims and attending court hearings
Desired Experience & Qualification
LLB degree
Admitted Attorney
4+ years PQE
Outstanding communication and negotiation skills
Excellent writing, research, and analytical skills
Demonstrated ability to effectively communicate with colleagues and clients.
Outstanding organizational and time-management skills
Dedicated and goal-oriented with a strong work ethic
