Our client - A prominent law firm in Bloemfontein, is looking for a qualified lawyer to work in its mining law department on a specific project for a client who is seeking to commence with mining operations. The commencement of the mining project is dependent on obtaining mineral right tenure on various mining rights. The successful candidate will be required to assist with the development of a project plan to obtain tenure on the mineral rights, by integrating all the different processes and procedures with different regulators, stakeholders (including landowners and host communities), and service providers, and once the project plan is finalized, to implement the project plan to deliver secure mineral right tenure for the client. This role does have a remote working option.
Duties & Responsibilities
Mineral rights applications, including applications for and renewals of mining rights and prospecting rights to the Department of Mineral Resources and Energy (“DMRE”) in terms of the Mineral and Petroleum Resources Development Act of 2002 (“MPRDA”);
Section 102 applications to the DMRE for amendment of mineral rights;
Applications for environmental authorization in terms of the National Environmental Management Act of 1998 (“NEMA”), the processes thereunder, including the requirements of public participation;
Applications for water use licenses in terms of the National Water Act of 2008 (“NWA”);
Applications for waste management licenses in terms of the National Environmental Waste Management Act of 2008 (“NEMWA”) for the creation of residue stockpiles (tailings or waste dams);
The integration of required licensing and other processes and procedures under the MPRDA, NEMA, NEMWA, etc. for purposes of obtaining and retaining mineral right tenure;
Social and labour plans required in terms of the regulations to the MPRDA and their implementation;
The requirements of the Mining Charter.
The candidate should have a background in project management.
Desired Experience & Qualification
Attorney admitted in South Africa.
A minimum of 3 – 5 years’ experience in mining law in South Africa.
Experience with Mining and Mineral Rights applications
The candidate should be self-motivated, energetic, and driven. The position requires the candidate to work with people of diverse backgrounds in different situations, and tact and resourcefulness are important traits for the position. Meeting project timelines are essential, as the commencement of mining is dependent on legal tenure – the development of the mine and projects associated therewith are running concurrently. The project will rely on good inter-personal skills and teamwork.
Literacy (language and computer) and communication skills should be excellent.
